Summary
Case Summary
On appeal from Court of Appeal of England and Wales (Civil Division)IssueWhether the indefinite notification requirements imposed by s 82 Sexual Offences Act 2003 are incompatible with article 8 of the European Convention on Human Rights.FactsThe respondents were convicted of sexual offences and sentenced to terms of imprisonment which made them subject to the notification regime under Part 2 Sexual Offences Act 2003 for an indefinite period. This required them to notify the police of their address and other details, annually and whenever these changed. They had to make a further notification when they spent 7 days or more per year at another address in the UK and whenever they left the UK. There was no provision for review of the notification requirement.
